ARCA is a community events and ticketing service: you join communities, get tickets to their events, and connect with other attendees in small group chats called bubbles. These Terms & Conditions (the "Terms") apply when you use the ARCA app, and when you buy or get a ticket on arcacommunity.app. Please read them: they explain what you can expect from us, what we expect from you, and how tickets, payments and refunds work. How we handle your personal data is explained in our Privacy Policy.
In these Terms:
2.1 By creating an account, by using the App, or by buying or getting a ticket on the Website, you accept these Terms. If you do not agree, do not use ARCA.
2.2 You must be 18 or over to create an account or to buy or get a ticket. The information you give us, including your date of birth, must be accurate and kept up to date.
2.3 Some Events are open to under-18s. A parent or guardian who is 18 or over may get a ticket for a child to attend such an Event; the child must not create an account. Whether an Event admits under-18s is shown on the Event and is the Host's decision.
2.4 If you use ARCA on behalf of a brand, Community or other organisation, you confirm that you are authorised to act for it and to bind it to these Terms.
3.1 ARCA lets you join Communities, discover and attend Events, hold tickets, and connect with other attendees in Bubbles.
3.2 ARCA is currently in early access. Features may be added, changed, interrupted, or withdrawn while we build, and availability is not guaranteed. We will try to give notice of significant changes where reasonably possible.
3.3 Events are organised and run by their Hosts, not by ARCA. Attendance is subject to the Host's and venue's own rules, and Hosts are responsible for the conduct and safety of their Events.
3.4 ARCA is offered in the United Kingdom.
4.1 You are responsible for your account and for all activity that happens under it. Keep your sign-in credentials secure and do not share them.
4.2 One account per person. You may not create an account for anyone else, impersonate another person or brand, or use another member's account.
4.3 Tell us promptly at hello@arcacommunity.app if you believe your account has been accessed without your permission.
4.4 We may suspend or close accounts that breach these Terms or that put other members, Hosts, or the service at risk (see section 19).
5.1 Brands may apply for a brand account by providing a brand name, handle, contact details and Instagram. Brand accounts are subject to review and approval by ARCA before activation, and approval may be withheld or withdrawn at our discretion.
5.2 Hosts can see the names and handles of attendees of their Events, including the names of guests who bought or got a ticket on the Website, and may check tickets at the door. Hosts must use attendee information only to run their Events and for no other purpose.
5.3 Hosts may refuse entry to, or remove, attendees for behaviour at their Events, in line with their own rules and applicable law.
6.1 We grant you a personal, limited, revocable, non-exclusive, non-transferable licence to install and use the App on your own device, for your personal, non-commercial use, in accordance with these Terms and, where you obtained the App from the Apple App Store, the scope described in section 7.2.
6.2 Except as permitted by applicable law, you must not:
6.3 All rights not expressly granted to you are reserved by us.
This section applies where you download the App from Apple's App Store, and is required by Apple.
7.1 Agreement with us, not Apple. These Terms are concluded between you and Ourstory Studios Limited only, not with Apple Inc. ("Apple"). The App is published on the App Store under the developer account of Christoph Davis, a director of Ourstory Studios Limited, on the company's behalf. We, not Apple, are solely responsible for the App and its content. Apple is not a party to these Terms.
7.2 Scope of licence. The licence granted in section 6 is a non-transferable licence to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules set out in the App Store Terms of Service, except that the App may also be accessed and used by other accounts associated with you via Family Sharing or volume purchasing, where available.
7.3 Maintenance & support. We are solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services for the App.
7.4 Warranty. We are solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund any purchase price you paid for the App (the App is free to download). To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are our sole responsibility.
7.5 Product claims. We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and/or use of it, including: (i) product liability claims; (ii) any claim that the App fails to conform to an applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
7.6 Intellectual property claims. If a third party claims that the App, or your possession and use of the App, infringes that third party's intellectual property rights, we, not Apple, are solely responsible for the investigation, defence, settlement, and discharge of that claim.
7.7 Legal compliance. You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
7.8 Developer contact. Questions, complaints, or claims about the App should be directed to Ourstory Studios Limited, 66 Wenham House, Ascalon Street, London SW8 4DZ, at hello@arcacommunity.app (see also section 26).
7.9 Third-party terms. You must comply with any applicable third-party terms of agreement when using the App, for example, your wireless data service agreement, and Google's or Apple's terms if you sign in with them (see section 14).
7.10 Third-party beneficiary. Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
8.1 The App and the Website, including the ARCA name and brand, design, interface, artwork, curated Photo Elements, and underlying software, belong to us or our licensors and are protected by intellectual-property laws. These Terms do not transfer any ownership in them to you.
8.2 Community and Event imagery belongs to the relevant Host or its licensors. Do not reuse it outside ARCA without permission.
8.3 Your Content remains yours, see section 9.
9.1 You own the Content you create on ARCA: your photos, your Arca, your messages, and your profile.
9.2 So the App can function, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display, and share your Content within ARCA as you direct: photos you post to a Community are shown to that Community, your Arca is revealed to Bubble members as you chat, and your name and handle appear where you take part. This licence ends when your Content is deleted from ARCA, except where limited copies must be retained for legal reasons or exist in routine backups for a short period.
9.3 Only upload Content you have the right to share. That includes having permission from people who appear in your photos, and not uploading material that infringes someone else's copyright, trade marks, privacy, or other rights.
9.4 You are responsible for your Content. We do not endorse member Content and are not responsible for it, though we may review and remove it as described in section 18.
10.1 Events may be free or paid. For paid Events, the full amount you will be charged — the ticket price plus the booking fee — is shown before you pay. Your payment is processed by Stripe, our payment processor. ARCA never sees or stores your card details. Stripe's own terms and privacy policy apply to the processing of your payment.
10.2 When you buy a ticket you are buying it from the Host of that Event. ARCA sells the ticket and collects the payment as the Host's agent, and holds it on their behalf until after the Event. Your contract for the Event itself — that it happens, when and where it happens, and what it is — is with the Host and not with ARCA.
10.3 The booking fee is ARCA's charge for providing and running the ticketing service. It is shown separately before you pay and is not part of what the Host receives.
10.4 Tickets are for an Event on a specific date, so the 14-day right to cancel that applies to many purchases made at a distance does not apply to them (Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, regulation 28(1)(h)). Each Event shows the Host's own refund policy before you buy.
10.5 Refunds for paid tickets are issued by the Event's Host through ARCA. A refunded ticket no longer admits you to the Event. Where a Host refunds your ticket at your request or their discretion, the ticket price is returned and the booking fee is retained, because the ticketing service has already been provided.
10.6 If an Event is cancelled, you are refunded in full — the ticket price and the booking fee — to the card you paid with. The same applies if an Event is postponed or changed in a way that means it is materially not the Event you bought a ticket for, and you tell us within a reasonable time that you no longer wish to attend.
10.7 You can have up to 4 tickets for any one Event. Tickets are personal to the holder and may not be resold. Hosts may check tickets at the door, by scanning them or by the holder's name.
10.8 Tickets on the Website. You can buy or get a ticket on the Website without an account, by giving your name and email address. A paid ticket is confirmed by the receipt we email you. A free ticket is confirmed only when you press the button in the confirmation email we send, which must happen within 30 minutes, while your place is held; until then nothing is booked. Your ticket admits you at the door under the name you gave, and moves into the App when you sign in with the same, verified email address or enter the order code from your email.
10.9 For Hosts: the ticket price we have collected on your behalf becomes due to you in full five days after your Event ends, and we pay it by bank transfer to the bank account you give us. We keep the booking fee. Changing your bank details holds your next payment for 48 hours and notifies everyone who runs your community.
10.10 For Hosts: if a cardholder's bank reverses a payment for one of your tickets — a chargeback — the money is taken back from us and the ticket stops being valid. That amount is deducted from what you are owed, and if you have already been paid it is deducted from your next payment for any of your Events. We show what is outstanding on your Earnings screen. We do not pass on the separate fee our payment processor charges us for handling the chargeback.
We collect and use personal data to run ARCA, as described in our Privacy Policy, which explains what we collect, why, the legal basis for it, who can see it, how long we keep it, and your rights. You can read it in the App and at arcacommunity.app/legal/privacy. We do not sell your personal data, and we do not use it for third-party advertising.
ARCA is a social app, and some of your information is shown to other members by design:
12.1 Communities: members of a Community can see the photos and Content you share to that Community, along with your name and handle.
12.2 Bubbles: members of a Bubble you join can see your messages and, gradually as you chat, your Arca as it is revealed.
12.3 Events: the Host of an Event you attend can see your name and handle on its attendee list and can check your ticket at the door.
12.4 Profile: your name, handle, and profile imagery appear wherever you take part in the App.
Think before you share: anything you post into a shared space can be seen by the other people in that space.
13.1 We take appropriate technical and organisational measures to protect your data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
13.2 You can delete your account at any time from inside the App, at Settings → Account → Delete account, or by emailing hello@arcacommunity.app from the address on your account. Records we must keep by law, such as the payment records behind tickets you bought, are kept with your name removed. How long we keep each kind of data is set out in the Privacy Policy.
14.1 ARCA relies on other companies to run: Google Firebase and Google Cloud (sign-in, database, file storage, server code, crash reports, notifications and checks that requests come from a genuine copy of ARCA), Stripe (payments), Apple (Sign in with Apple, notifications and device checks), Google Sign-In, Google reCAPTCHA (on the Website, to stop automated checkouts) and Hostinger (sending our emails). Each processes data on our behalf as described in the Privacy Policy.
14.2 If you choose to sign in with Google or with Apple, your use of that sign-in is also governed by that company's terms and privacy policy.
14.3 ARCA may contain links or references to third-party content, such as a Host's Instagram or a ticket seller's site. We are not responsible for third-party services, sites, or content, and linking to them is not an endorsement.
Some of the services in section 14 store or process data outside the United Kingdom, including in the United States. Where they do, we rely on the safeguards UK data protection law requires; the Privacy Policy explains which.
16.1 ARCA is for people aged 18 and over, and we do not knowingly collect personal data from anyone under 18, other than the name a parent or guardian gives when getting a ticket for a child (section 2.3).
16.2 If we discover that an account belongs to someone under 18, we will close the account and delete its data promptly. If you believe someone under 18 has an account, please tell us at hello@arcacommunity.app.
Be decent to each other. ARCA has zero tolerance for objectionable content and for abusive users: content or behaviour of that kind will be removed and can end your access to ARCA (see section 18). When using ARCA you must not:
18.1 We have zero tolerance for objectionable content and abusive users. We may review, moderate, restrict, or remove any Content that we reasonably believe breaches these Terms, is objectionable, is unlawful, or puts members or the service at risk, and may suspend or remove the responsible account. Hosts can also remove members from their Community.
18.2 How we protect you from illegal and harmful content. Bubbles hold at most four people. Messages in Bubbles are checked as they are sent, and a message containing abusive words is not posted. You can report a message or a member in a Bubble, or a Community's update, from inside the App, and report anything else by email; and you can block another member. Reports are reviewed by people at ARCA, and we remove illegal content, and the accounts responsible, as soon as we become aware of it.
18.3 Reporting. To report content, behaviour, or an account, use the report option in the App where there is one, or email hello@arcacommunity.app with a description of the issue and where in the App it happened. We review reports promptly: Content reported as objectionable is acted on within 24 hours of a valid report, including removing the Content and, where warranted, removing the user who provided it. Illegal content is removed as soon as we become aware of it.
18.4 Blocking. You can block members in the App so that you no longer interact with them. If you need help blocking someone, email hello@arcacommunity.app and we will apply the block for you.
18.5 Complaints and appeals. If you disagree with a decision we made about your Content or your account, or with how we handled a report, email hello@arcacommunity.app. We will look at it again, and tell you the outcome.
18.6 We may preserve and disclose Content and account information where we believe in good faith that the law requires it or that it is necessary to protect the safety of members or the public.
19.1 You can stop using ARCA at any time and can delete your account as described in section 13.2.
19.2 We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if we reasonably believe your conduct risks harm to other members, Hosts, or the service. Where practical and appropriate, we will tell you why.
19.3 On termination, your licence to use the App ends and your access to your account ceases. Tickets you have already paid for are dealt with under section 10. Sections that by their nature should survive, including sections 7, 8, 9.2 (to the limited extent stated), 13, and 21 to 25, continue to apply.
20.1 ARCA is in active development. We may change, suspend, or discontinue any part of the service.
20.2 We may update these Terms as ARCA grows. Material changes will be flagged in the App, and the "Last updated" date above will change. Changes do not affect tickets you have already bought. Continuing to use ARCA after a change takes effect means you accept the updated Terms; if you do not agree, stop using ARCA and delete your account.
21.1 Apart from the promises made in these Terms and the rights you have by law, ARCA is provided "as is" and "as available", while in early access and otherwise.
21.2 We do not promise that ARCA will be uninterrupted, error-free, or secure, that defects will be corrected, or that Content will be preserved.
21.3 Events are run by Hosts. We make no promises about any Event, venue, Host, or other member, and you attend Events and interact with other members at your own judgement.
22.1 We are not liable for losses that were not foreseeable when you accepted these Terms, for losses caused by Events run by Hosts or by other members' Content or conduct, or, if you use ARCA for business purposes, for loss of profit, business or opportunity.
22.2 Our total liability to you arising out of or relating to ARCA or these Terms is limited to the greater of £100 and the total you paid through ARCA (ticket prices and booking fees) in the 12 months before the claim arose.
22.3 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited, and nothing affects your statutory rights as a consumer.
If you use ARCA for business purposes, including as a Host, you agree to indemnify us against claims, losses, and reasonable costs (including reasonable legal fees) brought by a third party arising out of your Content, your use of ARCA in breach of these Terms, or your violation of applicable law or of another person's rights. We will notify you of any such claim and may take over its defence at our own expense.
We are not responsible for any delay or failure to provide ARCA caused by events beyond our reasonable control, including outages of third-party infrastructure (such as Google Firebase), internet or power failures, natural disasters, epidemics, civil unrest, or acts of government.
25.1 Governing law. These Terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales; if you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts.
25.2 Severability. If any part of these Terms is found unenforceable, the rest continues in full force.
25.3 Entire agreement. These Terms, together with the Privacy Policy and the refund policy shown on each Event, are the entire agreement between you and us about ARCA.
25.4 No waiver. If we do not enforce a provision of these Terms straight away, we can still enforce it later.
25.5 Assignment. You may not transfer your rights or obligations under these Terms. We may transfer these Terms to another organisation as part of a reorganisation or sale of the ARCA service, and will tell you if we do; this will not reduce your rights.
25.6 Third parties. Apart from Apple under section 7.10, no one other than you and us has any right to enforce these Terms.
